Membership Terms Agreement

• Age Requirement: Membership is available only to individuals who are at least 16 years old, or the age of majority in their jurisdiction, whichever is higher.
• Account Creation: To become a Member, you must provide accurate and complete information when registering an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

• Free Membership: Includes basic access to the Platform's features.
• Premium Membership: Offers additional benefits such as:
  • Exclusive content or early access to new features.
  • Discounts on marketplace purchases.
  • Enhanced points earning rates or special promotions.
• Membership Fees: If applicable, fees for premium memberships will be clearly stated, and payments must be made through approved methods. Membership pricing is subject to change, but changes will not affect existing paid subscriptions until renewal.

• Compliance: Members must use the Platform in compliance with all applicable laws and our Terms of Service, including not engaging in any illegal activities, spamming, or harassment.
• Content: You are responsible for the content you post. All content must adhere to our content guidelines, avoiding harmful, misleading, or infringing material.

• Respect: Treat other Members with respect, avoiding any form of discrimination, harassment, or bullying.
• Prohibited Actions: Do not attempt to disrupt, damage, or impair the Platform's functionality, nor infringe on the intellectual property of others.

• Points can be earned and used according to the Points Agreement, which is part of this membership.

• Rights: ViewGems retains all rights to its content, software, and technology. Members grant ViewGems a worldwide, royalty-free license to use, modify, and distribute content you post for the purpose of operating and promoting the Platform.

• By Member: You may terminate your membership at any time by closing your account. No refunds will be provided for any unused portion of paid memberships unless required by law.
• By ViewGems: We may suspend or terminate your membership for violation of this Agreement, fraudulent behavior, or for any other reason at our discretion. Upon termination, your right to use the Platform ceases, and any unused Points or benefits may be forfeited.

• ViewGems may update this Agreement. We will notify Members of significant changes via email or through the Platform. Continued use of the Platform after such notification constitutes acceptance of the changes.

• Your use of the Platform is also governed by our Privacy Policy, which outlines how we handle your personal information.

• ViewGems will not be liable for any direct, indirect, incidental, or consequential damages arising from your use of or inability to use the Platform, except where prohibited by law.

• Any disputes arising out of or relating to this Agreement will first be attempted to be resolved through mediation. If unsuccessful, disputes will be subject to the jurisdiction where ViewGems is headquartered.

• This Agreement shall be governed by and construed in accordance with the laws of California, United States of America, without regard to its conflict of law provisions.
